According to Anant Tripati, Deposed Former Agent and a Lieutenant Says that Los Angeles County District Attorney Admits to Providing False Statements to Obtain Search Warrants

LOS ANGELES, CA (SEND2PRESS NEWSWIRE) -- In a sworn deposition taken by Anant Tripati of testimony by Lt. Belen Jeske of the Los Angeles County District Attorney's office (Aug. 22, 2005 in BC326528) -- provided in a lawsuit filed in Los Angeles County alleging "Fraud Upon the Court" -- reveals it is common practice for agents of the LA District Attorneys Office to provide judges with false statements to obtain search warrants, and other false statements regarding property seized, inventory of property, custody of property, and disposition of seized property. The falsification of search warrant documents, inventory of property seized, chain of custody, and disposition of seized property, all led to the theft of proprietary software and other property owned by him during a 1992 search states Tripati.

Tripati also states that in subsequent deposition testimony provided October 19th, 2005 by former Los Angeles County District Attorneys Office agent Richard Goldston, Goldston admitted that he left two Arizona law enforcement officers alone to search and seize Tripati's office property and remove it to AZ with them. And, that no employee of Los Angeles County was present or verified or inventoried property seized and removed to Arizona by Arizona authorities. Goldstons testimony also states that several days after removing Tripati's property to Arizona, Arizona authorities sent Goldston a list of property Arizona authorities claims was taken by them when search warrant SW 34227 was executed. This testimony demonstrates Goldston intentionally lied to the court and Judge Candace Beason a week later when he stated "I further swear that this is a true and detailed account of the property taken by me' and "this property will be retained in my custody" in the "return to search warrant SW 34227" he filed in court one week later.

"The memos submitted to Los Angeles County Counsel, the documents submitted to Los Angeles County Risk Management, as well as the police reports created by Richard Goldston all show Goldston stating in writing that Goldston had personally verified what property was taken when search warrant SW 34227 was executed, when in fact he did not. If Los Angeles County authorities would have verified what property was being removed from my office, I do not believe my software and property would have been stolen by Arizona authorities", says Anant Tripati.

On March 27th, 2006 Judge Paul Gutman of Department 34 in the Los Angeles County Superior Court will hear Tripati's claims regarding this fraud upon the court. Lawyers familiar with search warrants state if it is proven that no employee of Los Angeles County verified what items of property were removed by Arizona Police Officers and if Tripati can prove Arizona Police participated in the search and seizure, under the "Fraud Upon The Court" and "Unclean Hands Doctrines", Los Angeles County will be precluded from presenting a defense. One cannot and must not be allowed to design a scheme to defraud the court and obtain benefit from the fraud asserts Tripati.

According to Court Records, lawyers for Los Angeles County have refused to address the fraud upon the court issues, states Tripati.
